Legal Advice
I work for a Thai company and we're only entitled to 6 days Annual Leave a year. Most of my colleagues working for international companies say they're allowed 12 days leave. Can it vary that much??
This will vary depending on what your company has decided upon with HR and Management and in many cases may be less than 12 days, also may be dependent and accumulated on a pro rata basis and also what is stated and agreed upon by you and your employer in your employment contract and how long you've been working with the company.
Is the amount of sick days the same for each company?
Employees are entitled up to a maximum of 30 days sick leave per year. Note that this does not apply to all companies as many will have their own number of days as agreed upon by HR and Management. In many cases, if more than 2 days are taken consecutively, you may be asked to provide a medical certificate. Also it tends to look suspicious if you fall sick on a Friday or a Monday...for obvious reasons!
I'm a foreigner new to Thailand and would like to know what documents I need for a work permit?
You will be required to provide personal documentation verified, however the majority of documentation will need to be collated by your company. For further assistance, please feel free to contact us.
What is the maximum length of probation period allowed?
Under Thai Law, the maximum probation period allowed is 4 months.
Do I get paid out if I'm fired?
This is dependent on many factors, please refer to the "Termination of Employment" as a rough guide regarding your rights and severance payout calculations. For expert advice, we suggest you enlist the advice of a lawyer.
What is the difference between being laid off and fired?
"Laid off" is the result of a company's financial performance.
"Fired" is the result due to an employee's performance.
